Vinculatividade do Incidente de Resolução de Demandas Repetitivas (IRDR) e possibilidade de revisão: Análise sob a ótica da Segurança Jurídica

Abstract

This paper aims to analyze the legal context involving the institute called “Incident of Solving Repetitive Demands”, in itself and also considering several controversies, like the possibility of considering it as Binding precedents, the procedure involved in the judgment and revision of theses and, finally, effects modulation of the decision in the time. Thus, these aspects will be analyzed under the aspect of legal certainty, for the purpose of checking if the institute of IRDR fulfills its role to standardize the understanding of the courts with due legal certainty.
