| Summary: | Este trabalho analisa os impactos da subordinação algorítmica e da organização do trabalho por meio de plataformas digitais no contexto brasileiro, com foco nas transformações das relações laborais sob a lógica da uberização. A pesquisa parte da constatação de que os instrumentos tradicionais do Direito do Trabalho têm se mostrado insuficientes diante das novas formas de gestão do trabalho, baseadas em tecnologias de controle e avaliação automatizada. A partir do julgamento do STF sobre a ausência de vínculo entre motoristas e plataformas, o estudo propõe uma reflexão crítica sobre os limites da atual tutela jurídica e defende a reimaginação do Direito do Trabalho brasileiro, com base na primazia da realidade, na ampliação da proteção coletiva e na incorporação de novos parâmetros normativos que enfrentam as especificidades do trabalho em plataformas digitais. |
| Abstract: | This study examines the impacts of algorithmic subordination and platform-based labor organization in the Brazilian context, focusing on how labor relations are being reshaped under the logic of "uberization." The research highlights the inadequacy of traditional labor law tools when faced with new forms of work management, driven by technologies of automated control and performance evaluation. Using the Brazilian Supreme Federal Court's decision on the absence of employment relationship between drivers and digital platforms as a starting point, the paper offers a critical reflection on the limitations of current legal protections. It argues for a reimagining of Brazilian Labor Law, grounded in the primacy of reality, the strengthening of collective protection, and the adoption of new regulatory frameworks capable of addressing the specific challenges of platform labor. |
