| Summary: | Este artigo tem como objetivo analisar o impacto da implementação de sistemas automatizados no sistema judiciário brasileiro. A pesquisa, que utilizou métodos qualitativos como a revisão bibliográfica e a análise de casos reais, investiga os desafios éticos e legais decorrentes da adoção dessa tecnologia. O trabalho identifica como problemática central a atribuição de responsabilidade pelo uso de sistemas autônomos, um desafio jurídico agravado pela opacidade algorítmica ("caixa-preta"), pela imprevisibilidade de seus resultados e pelo viés de automação. Para investigar essa questão, o estudo analisa a possibilidade de uma abordagem baseada na teoria do risco levando em conta iniciativas regulatórias, como as resoluções emitidas pelo Conselho Nacional de Justiça (CNJ) e o Projeto de Lei nº 2338/2023. O trabalho conclui que a tecnologia deve ser vista como um instrumento de apoio, com a supervisão humana sendo fundamental para a garantia de um processo justo, ético e transparente. |
| Abstract: | This article analyzes the impact of implementing automated systems in the Brazilian judicial system. The research, which used qualitative methods such as a literature review and real-life case analysis, investigates the ethical and legal challenges arising from the adoption of this technology. The study identifies the assignment of responsibility for the use of autonomous systems as a central issue, a legal challenge exacerbated by algorithmic opacity ("black box"), the unpredictability of their results, and automation bias. To investigate this issue, the study analyzes the possibility of a risk theory-based approach, taking into account regulatory initiatives such as the resolutions issued by the National Council of Justice (CNJ) and Bill No. 2338/2023. The study concludes that technology should be viewed as a supportive tool, with human oversight being essential to ensuring a fair, ethical, and transparent process. |
