Os crimes contra a honra no ambiente digital: análise dos aspectos legais e dos desafios contemporâneos no Brasil

Abstract

This paper aims to analyze the intricate relationship between the expansion of the digital environment and the evolution of different cybercrimes, considering that free speech, while essential, is frequently used to justify opinions that cause transgressions to the fundamental rights of others, as is the case with manifestations of intolerance and discrimination. The study highlights the challenge of balancing free speech in a plural online environment with the necessity of protecting rights and curbing harmful conduct, in particular, crimes against honor. The difficulty in holding 2 perpetrators of virtual crimes accountable, given the complexity of tracking and identification, is also addressed. In summary, the article presents the challenge of establishing restrictions on free speech in the digital sphere, in order to prevent violations of the constitutional rights of third parties. Furthermore, the study argues for the urgency of adapting laws and oversight mechanisms to this reality, defining clear limits for online freedom and implementing measures that ensure a safer, more respectful, and democratic virtual space for all users.
