| Summary: | O presente trabalho propõe uma análise do poder investigatório do Ministério Público, buscando identificar os fundamentos e os limites constitucionais desse poder e as implicações práticas no procedimento investigatório criminal (PIC). Para isso, utilizou-se o método dedutivo, no qual se partirá de um estudo amplo do Ministério Público, analisando sua posição constitucional e suas funções institucionais na persecução penal, bem como investigando o histórico dos julgados do Supremo Tribunal Federal. Ao fim, apreende-se da pesquisa que o poder investigatório do Ministério Público tem legitimidade constitucional, porém deve ser exercido dentro dos limites estabelecidos pelo sistema constitucional brasileiro e pelas normas do ordenamento jurídico em vigor. |
| Abstract: | The present work proposes an analysis of the investigative power of the Public Ministry, seeking to identify the foundations and constitutional limits of this power and the practical implications in the criminal investigative procedure (PIC). For this, the deductive method was used, which will start with a broad study of the Public Ministry, analyzing its constitutional position and its institutional functions in criminal prosecution, as well as investigating the history of the Federal Supreme Court's judgments. In the end, the research concludes that the investigative power of the Public Ministry has constitutional legitimacy but must be exercised within the limits established by the Brazilian constitutional system and the rules of the legal system in force. |
