| Summary: | O presente trabalho analisa a natureza jurídica dos ativos virtuais negociados em jogos digitais — skins, moedas virtuais, itens cosméticos e funcionais — e a possibilidade de sua transmissão sucessória no ordenamento jurídico brasileiro, a despeito da qualificação contratual que as plataformas atribuem a esses bens como objeto de mera licença de uso, revogável e intransferível. Parte-se da constatação de que a indústria dos jogos digitais movimenta cifras bilionárias, impulsionada por modelos de microtransações, loot boxes e battle passes que conferem escassez artificial e valor de mercado a itens exclusivamente digitais, fenômeno evidenciado pelo mercado secundário de skins de Counter-Strike. A pesquisa examina, em seguida, o regime contratual imposto pela Valve (Steam), pela Riot Games e pela Epic Games, identificando cláusulas que negam ao usuário qualquer direito de propriedade e vedam a transmissão de contas e itens por sucessão, e confronta essas cláusulas com os limites que o Código de Defesa do Consumidor (CDC), o Código Civil, a Lei do Software, o Marco Civil da Internet e a Lei Geral de Proteção de Dados Pessoais impõem à autonomia privada das desenvolvedoras. Na sequência, qualificam-se os ativos virtuais como bens incorpóreos, dotados de individualização, escassez juridicamente relevante e conteúdo patrimonial enquadrável no artigo 83, inciso III, do Código Civil, examinando-se precedentes estrangeiros — como Ajemian v. Yahoo! e a decisão do Bundesgerichtshof alemão — e tendências normativas internas, com destaque para o Projeto de Lei nº 4/2025, de reforma do Código Civil. A partir desses fundamentos, demonstra-se que a transmissão causa mortis desses ativos não encontra óbice dogmático no regime sucessório vigente, fundado no princípio da saisine, propondo-se um tratamento sucessório estruturado em três eixos — interpretativo, processual e legislativo — capaz de superar os obstáculos contratuais impostos pelas plataformas. A pesquisa, de natureza bibliográfica e documental, conduzida pelo método dedutivo e com recurso pontual ao método comparativo, conclui que o sistema civilista brasileiro já dispõe dos instrumentos dogmáticos necessários para reconhecer a skin como patrimônio transmissível, restando, sobretudo, a superação da resistência contratual e prática das plataformas digitais. |
| Abstract: | This paper analyzes the legal nature ofvirtual assets traded in digital games — skins, virtual currencies, cosmetic and functional items — and the possibility oftheir transmission through inheritance under Brazilian law, despite the contractual classification platforms assign to these assets asthe object ofa mere, revocable and non-transferable license. It starts from the observation that the digital game industry moves billions of dollars, driven by microtransaction, loot box and battle pass models that create artificial scarcity and market value for purely digital items, a phenomenon clearly evidenced by the secondary market for Counter-Strike skins. The research then examines the contractual regime imposed by Valve (Steam), Riot Games and Epic Games, identifying clauses that deny users any property right and prohibit the transmission ofaccounts and items through succession, and weighs these clauses against the limits that the Consumer Protection Code, the Civil Code, the Software Act, the Brazilian Internet Civil Framework and the General Data Protection Law impose on developers' private autonomy. The study then qualifies virtual assets as intangible property, endowed with individualization, legally relevant scarcity and patrimonial content falling within article 83, item III, ofthe Civil Code, examining foreign precedents — such as Ajemian v. Yahoo! and the German Bundesgerichtshof's decision — and domestic regulatory trends, particularly Bill nº 4/2025, which proposes a reform ofthe Civil Code. Building on these foundations, the paper shows that the causa mortis transmission ofthese assets faces no dogmatic obstacle under the current succession regime, grounded in the saisine principle, and proposes a succession framework structured around three axes — interpretive, procedural and legislative — capable ofovercoming the contractual obstacles imposed by platforms. The research, ofa bibliographic and documentary nature, conducted through the deductive method and occasional recourse to the comparative method, concludes that the Brazilian civil law system already possesses the dogmatic tools needed to recognize the skin as transmissible property, with the main remaining challenge being the contractual and practical resistance of digital platforms. |
