Abstract

Disability benefits in the General Social Security System (RGPS) constitute an essential safety net, ensuring the sustenance of insured individuals in situations of vulnerability due to illness or accident. This article aims to analyze the main obstacles faced by insured individuals in the process of recognizing their rights to these benefits. The research, conducted through bibliographic review, addresses aspects such as the subjectivity of medical expertise and the potential impacts of the 2019 Social Security Reform on this issue. Furthermore, it identifies that the National Institute of Social Security (INSS) faces a decrease in the efficiency of the services provided, which has led to a significant increase in judicial claims. It is emphasized that this judicialization has become a recurring response from insured individuals due to the delays and uncertainties in the administrative process, highlighting the need for improvements in the system to ensure more efficient and fair service.
