| Summary: | A presente pesquisa analisa o direito fundamental à propriedade no ordenamento jurídico brasileiro, consubstanciado no latifúndio sob a perspectiva do atendimento à função social como elemento essencial ao seu exercício e as limitações impostas pelo Estado Democrático de Direito. O foco da pesquisa se consubstancia na possibilidade de compatibilizar o modelo latifundiário de produção com as demandas sociais por uma distribuição mais equitativa de terras, pelo que se presta o presente estudo a perquirir sobre a existência ou não de antagonismo entre o latifúndio produtivo e os objetivos constitucionais da reforma agrária. Assim, se analisou a questão partindo da premissa geral da função social do direito à propriedade para se chegar ao entendimento específico dos limites e possibilidades desse direito no contexto do latifúndio, avaliando-se em que medida essas intervenções atendem de fato a justiça social sem comprometer a eficiência produtiva e a segurança jurídica. |
| Abstract: | This research examines the fundamental right to property within the Brazilian legal system, specifically in the context of latifundia, from the perspective of fulfilling its social function as a crucial aspect of its exercise and the restrictions imposed by the Democratic Rule of Law. The study examines the potential for aligning the latifundia production model with Societal demands for more equitable land distribution. Therefore, this research aims to determine whether there is or is not conflict between productive latifundia and the constitutional goals of agrarian reform. The approach used, started from the general premise of the social function of the right to property to develop a specific understanding of its limitations and potential within the latifundia context, evaluating how well these measures support social justice without undermining productive efficiency or legal certainty. |
