| Summary: | Este trabalho analisa a proteção dos direitos indígenas no Brasil, destacando violações sistemáticas, como os casos Yanomami e Munduruku, e as respostas jurídicas nacionais e internacionais. O objetivo central é avaliar a efetividade dos instrumentos de proteção, como a Convenção 169 da OIT e as decisões da Corte Interamericana de Direitos Humanos, no combate a crimes ambientais, especialmente o garimpo ilegal. A metodologia qualitativa, baseada em análise documental e jurisprudência, demonstra a persistência de violações mesmo após determinações judiciais, revelando falhas estruturais na fiscalização e na implementação de políticas públicas. |
| Abstract: | This study examines the protection of indigenous rights in Brazil, highlighting systematic violations such as the Yanomami and Munduruku cases, along with national and international legal responses. The central objective is to evaluate the effectiveness of protective instruments, including Convention 169 and rulings from the Inter-American Court of Human Rights, in combating environmental crimes, particularly illegal mining. The qualitative methodology, based on document analysis and jurisprudence, demonstrates the persistence of violations even after judicial rulings, revealing structural deficiencies in oversight and public policy implementation. |
