Abstract

The Maria da Penha Law brought, after its implementation, a series of novelties, both for the legal environment and for society as a whole, since it established the understanding that domestic and family violence are violations of human rights. humans. Therefore, it is necessary that there are always public debates about this problem that plagues our planet. However, it was after the tragic and historic case of Maria da Penha Maia Fernandes, which occurred in Brazil in 1983, that caused commotion and frustration with the slowness of the judicial process, given that only after almost two decades of the crime, which the aggressor was condemned and punished for his criminal practices, demonstrating the need for legislative reform. For this reason, this article develops a theme about how important the implementation of Law n. 11.340/2006, which in its normative text was based on constitutional principles, always seeking to protect victims, allowing the hidden figure to decrease more and more and for victims to be encouraged and denounced, as well as to be sure the effectiveness and legal effectiveness of the law.
