| Summary: | Este artigo tem como objetivo analisar o papel do administrador judicial e suas atribuições dentro do instituto jurídico da Recuperação Judicial no Brasil, estabelecido pela Lei Federal n.º 11.101/2005 junto às recentes alterações realizadas pela Lei 14.112, 2020, haja vista os impactos da atuação deste profissional para garantir o sucesso do processo recuperacional. Dessa forma, busca-se comprovar que o administrador judicial é imprescindível para a operacionalização do instituto e para a reestruturação da empresa em crise, de modo a efetivar o Princípio da Preservação da Empresa, mantendo a sua Função Social e preservando o interesse societário e da sociedade civil. |
| Abstract: | This article aims to analyze the role of the bankruptcy trustee and his attributions within the legal institute of the Reorganization and Bankruptcy Law in Brazil, established by the Federal Law of Insolvency No. 11.101/2005, combined with the Law 14.112/2020, in view of the impacts of the acts performed by this professional in order to ensure the success of the Reorganization process. In this way, seeks to verify how the bankruptcy trustee is essential for the operationalization of the institute and the maintenance of the company in crisis, in order to actualize the Principle of the Preservation of the Enterprise, maintaining its Social Function and preserving the interest of society and society Civil. |
