| Summary: | O presente artigo tem como objetivo central expandir a compreensão geral sobre o tema superendividamento e mínimo existencial, bem como realizar uma crítica ao teor do Decreto presidencial nº 11.150/2022, a partir de uma análise legislativa, histórica e doutrinária, referente ao período pós-constituinte de 1988 até o ano de 2022. O trabalho foi construído por meio de pesquisa bibliográfica, a partir, especialmente, da análise lógica de artigos científicos, textos, obras, notícias e disposições legislativas. Ao final, chegou-se à conclusão de que o Decreto nº 11.150/2022 é inconstitucional e deve ser revisado ou revogado. |
| Abstract: | The main objective of this article is to expand the general understanding on the subject of over-indebtedness and the existential minimum, as well as to carry out an analysis of the content of Presidential Decree nº 11.150/2022, based on a legislative, historical and doctrinal analysis, referring to the post constituent from 1988 until the year 2022. The article was built through bibliographical research, based, especially, on the logical analysis of scientific articles, in addition to texts, works, news and legislative provisions. In the end, it was concluded that Decree nº 11.150/2022 is unconstitutional and must be revised or revoked. |
