| Summary: | O presente artigo irá abordar de início a conceituação legal, doutrinária, os fundamentos, o procedimento e a hipótese de incidência da prescrição intercorrente nas execuções fiscais, assim como suas características e objetivos. Em seguida, será discorrido sobre as novas teses firmadas pelo Superior Tribunal de Justiça – STJ no julgamento do Recurso Especial nº 1.340.553 – RS, sob o rito de recursos repetitivos, sendo explanado as principais mudanças fixadas no recente entendimento jurisprudencial. |
| Abstract: | This article will initially address the legal and doctrinal concepts, the fundamentals, the procedure and the hypothesis of incurrence of intercurrent prescription in tax enforcement, as well as its characteristics and objectives. Then, it will be discussed about the new theses signed by the Superior Court of Justice - STJ in the judgment Special Appeal nº. 1.340.553/RS, under the rite of repetitive appeals, explaining the main changes established in the recent jurisprudential understanding. |
