Resumo
O presente trabalho tem como finalidade discutir a multiparentalidade, bem como os
efeitos do seu reconhecimento em âmbito jurídico. Ao longo das décadas, a
definição de família sofreu inúmeras mudanças, transformações essas,
reconhecendo vários arranjos familiares como entidade, tendo em consequência
sido necessária a adaptação do direito brasileiro, para a evolução do sistema
legislativo. Devido a impasses jurídicos perante essas modificações, surge a
multiparentalidade, a qual contempla o princípio da dignidade da pessoa humana e
privilegia os interesses da criança e do adolescente, por não definir a paternidade de
forma singular, o que consequentemente altera os devidos efeitos jurídicos da
filiação. Assim, a pesquisa utilizou-se de pesquisa bibliográfica, jurisprudencial,
legislativa e doutrinária, com a finalidade de proporcionar melhores e maiores
informações sobre o tema. Também se usou o método dedutivo, partindo-se da
premissa da família enquanto núcleo básico da sociedade e se chegando na
multiparentalidade enquanto estrutura validada pelo afeto, analisando-se a múltipla
ascendência e se examinando os efeitos morais e patrimoniais decorrentes dessa,
acercando-se ao fim da validade e efetividade desta nova modalidade de família.
Abstract
The aim of this work is to discuss multiple parenthood and also the effect of its
recognition in the juridical ambit. Over decades, the definition of family has passed
through innumerable changes which recognized several family arrangements as
entity. Consequently, it has been necessary the adaptation of Brazilian Law to take
Evolution into legislative system. Due to juridical impasses towards these
modifications, multiple parenthood appears. It contemplates the human person’s
dignity principle and privileges the interests of children and teens, by not defining
parenthood on a single way, which consequently changes the juridical effects of
filiation. Therefore, bibliographical, jurisprudential, legislative and doctrinal
researches were used to provide better and greater information about the subject.
The deductive method was also used, starting from the premise of the family as the
basic nucleus of the society and arriving at the multiparentality as a structure
validated by the affection, analyzing the multiple ancestry and examining the moral
and patrimonial effects deriving therefrom, approaching to the end of the validity and
effectiveness of this new modality of family.
