| Summary: | O agravamento da crise ambiental vivenciado pela humanidade ao longo do século XX, bem como a constatação de que o meio ambiente trata-se de elemento fundamental para a constituição de uma vida digna ao ser humano, trouxe à sociedade internacional a preocupação de se estabelecer sistemas de proteção ambiental a nível internacional. O presente trabalho tem como escopo analisar a tratativa do Direito Internacional em relação aos danos ambientais transfronteiriços, observando o sistema diferenciado de responsabilidade internacional dos Estados que lhe incumbe bem como sua relação com o conceito de soberania estatal. O estudo possui caráter qualitativo e a metodologia adotada consiste fundamentalmente em pesquisa bibliográfica e análise jurisprudencial. Como conclusão, observa-se que é necessário que o Direito Internacional evolua no sentido de quebras os paradigmas clássicos de soberania e responsabilidade internacional e adotar a cooperação internacional como forma efetiva de proteger o meio ambiente em escala global. |
| Abstract: | The worsening of the environmental crisis experienced by humanity throughout the 20th century, as well as the acceptance that the environment is a fundamental element for the constitution of a dignified life for the human being, has brought to international society the concern to establish systems of international environmental protection. The present work aims to analyze the treatment of international law in relation to transboundary environmental damage, observing the differentiated system of international responsibility of the States that it takes, as well as its relation with the concept of state sovereignty. The study has a qualitative character and the adopted methodology consists mainly in bibliographical research and jurisprudential analysis. It is concluded that international law needs to evolve in order to break the classic paradigms of sovereignty and international responsibility and to adopt international cooperation as an effective instrument for protecting the environment on a global scale. |
