| Title: | LGPD, inteligência artificial e compliance: o dever da transparência algorítmica |

| Summary: | A crescente delegação de decisões a sistemas de inteligência artificial, alimentados por grandes volumes de dados pessoais, instaurou uma tensão estrutural entre a opacidade dessas tecnologias, o fenômeno da "caixa-preta" e a efetividade dos direitos dos titulares. Diante desse cenário, o presente trabalho investiga como a Lei Geral de Proteção de Dados (Lei nº 13.709/2018) pode orientar e exigir práticas de compliance voltadas à transparência algorítmica, conciliando a proteção de direitos fundamentais com a preservação da competitividade e da inovação empresarial. Adotou-se abordagem qualitativa, mediante revisão bibliográfica e análise documental, orientada pelo método jurídico-dogmático. A pesquisa demonstra que a opacidade dos algoritmos compromete direitos como a privacidade, a igualdade, a não discriminação e a autodeterminação informativa, e que a LGPD oferece os fundamentos normativos da transparência algorítmica ao consagrar os princípios da transparência e da responsabilização, garantir o direito à explicação e à revisão de decisões automatizadas e instituir o relatório de impacto à proteção de dados. Reconhece-se, contudo, que a transparência absoluta é inalcançável diante de limites técnicos, jurídicos e práticos, razão pela qual se defende uma transparência proporcional, calibrada conforme o risco e o impacto de cada sistema. Conclui-se que a transparência algorítmica e o compliance são faces complementares de uma mesma exigência, pois a lei fornece o fundamento normativo e o compliance os meios de sua realização prática, institucionalizando a inteligibilidade, a auditabilidade e a prestação de contas. |
| Abstract: | The growing delegation of decision-making to artificial intelligence systems, fueled by large volumes of personal data, has established a structural tension between the opacity of these Technologies, the so-called "black box" phenomenon, and the effectiveness of data subjects rights. Against this backdrop, this study investigates how the Brazilian General Data Protection Law (Law No. 13,709/2018) may guide and require compliance practices aimed at algorithmic transparency, reconciling the protection of fundamental rights with the preservation of business competitiveness and innovation. A qualitative approach was adopted, based on bibliographic review and documentary analysis, guided by the legal-dogmatic method. The research demonstrates that algorithmic opacity undermines rights such as privacy, equality, nondiscrimination, and informational self-determination, and that the LGPD provides the normative foundations for algorithmic transparency by enshrining the principles of transparency and accountability, guaranteeing the right to explanation and to the review of automated decisions, and establishing the data protection impact assessment. It is acknowledged, however, that absolute transparency is unattainable in light of technical, legal, and practical constraints, which is why this study advocates for proportional transparency, calibrated according to the risk and impact of each system. It is concluded that algorithmic transparency and compliance are complementary facets of a single requirement, as the law provides the normative foundation and compliance provides the means for its practical implementation, institutionalizing intelligibility, auditability, and accountability. |
