| Summary: | O presente trabalho de conclusão de curso propõe uma reflexão sobre as restrições aos direitos fundamentais, especialmente no que concerne ao procedimento de Busca e Apreensão em alienação fiduciária executado por prestadores de serviços das assessorias de cobrança. Para tanto, a presente dissertação evidencia o lado positivo do instituto e sua relevância para a economia brasileira no contexto histórico e político da criação do decreto-lei 911/1969 e atualmente, e em paralelo confronta com a possibilidade de restrição dos direitos fundamentais em sede de busca e apreensão em alienação fiduciária. |
| Abstract: | This final course paper proposes a reflection on the restrictions to fundamental rights, especially concerning the Search and Seizure procedure in fiduciary alienation executed by debt collection service providers. To this end, this dissertation highlights the positive aspects of the institution and its relevance to the Brazilian economy in the historical and political context of the creation of Decree-Law 911/1969 and currently, and in parallel confronts it with the possibility of restricting fundamental rights in the context of search and seizure in fiduciary alienation. |
