| Summary: | Imersos em um mundo, no qual o uso de tecnologias intrusivas transformacionais já não se restringem mais ao espaço virtual, mas se incorporam cada vez mais no espaço físico, os efeitos associados às aplicações desses sistemas nas diversas áreas sociais também causam impactos significativos no funcionamento dos subsistemas sociais. Diante disso, propõe-se estudar o direito à desindexação no ordenamento jurídico brasileiro. A desindexação é o processo de remoção de conteúdos ou links específicos do índice de um motor de busca, impedindo que esses apareçam nos resultados de pesquisa. Esse procedimento é frequentemente solicitado por indivíduos que desejam restringir a visibilidade de determinadas informações online que possam estar desatualizadas, ser irrelevantes ou prejudicar sua reputação. Assim, tem-se como problema central o uso indevido do nome pelos motores de busca e parte-se da hipótese de que haveria fundamento, no ordenamento jurídico brasileiro, para o reconhecimento de um direito à desindexação. |
| Abstract: | Immersed in a world where the use of information and communication technology no longer remains confined to the virtual space but increasingly penetrates the physical sphere, the effects associated with the application of these systems in various social domains significantly impact the functioning of social subsystems. In this context, this work proposes to study the right to de-indexing within the Brazilian legal system. De-indexing refers to the process of removing specific content or links from a search engine’s index, preventing them from appearing in search results. This procedure is often requested by individuals seeking to restrict the visibility of online information that may be outdated, irrelevant, or harmful to their reputation. Therefore, the central issue of this research is the improper use of a person’s name by search engines, and it starts from the hypothesis that the Brazilian legal framework contains grounds for recognizing a right to de-indexing. |
