Summary:	O presente trabalho de conclusão de curso investiga o constitucionalismo haitiano a partir da perspectiva do “Atlântico Negro” de Paul Gilroy. O objetivo concentrou-se em propor o termo “Direito Achado no Mar” como um paradigma jurídico-discursivo, que reflete a luta e as práticas discursivas dos escravizados e negros libertos produzidas por meio dos fluxos transatlânticos, redirecionando às garantias, à liberdade e à cidadania, a partir do constitucionalismo haitiano. O estudo posiciona a Revolução Haitiana como um movimento político importante que conduziu à formação da primeira Constituição a abolir a escravidão. A partir disso, foi utilizada a metodologia da análise do discurso de Michel Foucault vinculada ao marco teórico Atlântico Negro para analisar as categorias liberdade e cidadania por meio dos textos selecionados. Os resultados alcançados destacam as Constituições de 1801 e 1805 do Haiti, como uma ruptura aos mecanismos de poder e saber do colonialismo, bem como um processo que teceu uma nova formação discursiva enraizada nas práticas enunciativas transatlânticas. As considerações finais evidenciam a relevância de localizar o movimento político-jurídico desencadeado no Haiti na história constitucional, a partir dos primas do sul global.
Abstract:	This term paper investigates Haitian constitutionalism from the perspective of Paul Gilroy's “Black Atlantic”. The aim is to propose the term “Law Found at Sea” as a legal-discursive paradigm that reflects the struggle and discursive practices of the enslaved and freed blacks produced through transatlantic flows, redirecting guarantees, freedom and citizenship from Haitian constitutionalism. The study positions the Haitian Revolution as an important political movement that led to the formation of the first constitution to abolish slavery. Based on this, Michel Foucault's discourse analysis methodology linked to the Black Atlantic theoretical framework was used to analyze the categories of freedom and citizenship through the selected texts. The results highlight Haiti's Constitutions of 1801 and 1805 as a break with the power and knowledge mechanisms of colonialism, as well as a process that wove a new discursive formation rooted in transatlantic enunciative practices. The final considerations highlight the importance of locating the political-legal movement unleashed in Haiti in constitutional history, based on the primacies of the global South.
