| Summary: | O contexto atual pautado por uma cultura cibernética, marcada pelo elo entre indivíduos e o uso desenfreado das tecnologias informacionais, promove uma economia baseada no uso de dados como fonte de produção em que através da mineração destas informações torna-se possível traçar perfil comportamental e induzir a tomada de decisões individuais. Neste sentido, viu-se a necessidade de instituir a governança aos dados pessoais, face a concepção destes como ativo econômico e, paralelamente, regulamentar o tratamento de dados por meio da Lei Geral de Proteção de Dados – LGPD, diante da ameaça aos direitos e garantias fundamentais da privacidade e liberdade dos titulares. Desta premissa, o presente estudo debruçase sob o método dedutivo e na pesquisa bibliográfica e documental como de apreciar a contribuição das diretrizes da Lei nº 13.709/2018 com enfoque no Poder Público com gestor e controlados dos dados pessoais. |
| Abstract: | The current context guided by a cybernetic culture, marked by the link between individuals and the unbridled use of information technologies, promotes an economy based on the use of data as a source of production in which, through the mining of this information, it becomes possible to draw a behavioral profile and induce individual decision-making. In this sense, it was seen the need to institute the governance of personal data, in view of the conception of these as an economic asset and, at the same time, to regulate the processing of data through the General Data Protection Law – LGPD, in view of the threat to the fundamental rights and guarantees of privacy and freedom of the holders. From this premise, the present study focuses on the deductive method and on bibliographic and documentary research as to appreciate the contribution of the guidelines of Law Nº. 13,709/2018 with a focus on the Public Power with manager and control of personal data. |
