A criminologia radical (ou crítica) como alternativa político-criminal ao atual sistema penal de controle social

Abstract

The theme of this research is the political-criminal strategy proposed by the theory of radical (or critical) criminology, as a response to the current system of social control, which is based on the ideology of social defense (or social control). The research problem focuses on the existing contradiction between the apparent failure of the penal system and its permanence throughout history. The respective hypothesis is based on the fact that the aforementioned system of social control, legitimized by the ideal of social defense, has true political and economic success, in view of its real functions and objectives (hidden). The general objective of this research is to present a political-criminal strategy to the social control system, considering that it is unfair, selective and unequal. Specific objectives of the present work are the approach of the ideology of social defense (or of social control) and of the several criminological theories until the radical criminological theory (or critical) was developed. Radical criminology proposes immediate strategies that culminate in the immediate overcoming of the capitalist political-economic system. For, considering the historical relationship between the penal system of social control and the social structure, it will only be possible to radically rethink the former of that if there is a modification of this one. The approach method used is deductive. As for the methods of procedure, they are embodied in the comparative and in the functionalist. Finally, the research technique used is the literature relevant to the topic.
