| Summary: | A presente pesquisa tem como objetivo discorrer sobre a violência intrafamiliar com o fito educacional contra crianças e adolescentes, além de apresentar a importância da Lei Menino Bernardo para a quebra da cultura da violência. Busca-se também discutir o conflito de direitos gerado pela referida lei, quais sejam: a liberdade dos pais de punir os filhos e o direito destes de terem suas integridades física e psíquica salvaguardadas no âmbito familiar, e para tanto, é imperioso apresentar os limites do poder familiar e a necessária intervenção estatal para garantir o melhor interesse da criança. Assim, por meio da análise de diversas normas jurídicas que buscam proteger os direitos dessa parcela vulnerável da população e por meio de um estudo doutrinário e casuístico é possível verificar que a violência não deve ser associada à educação, pois esses dois termos são excludentes. |
| Abstract: | This research aims to discuss the intrafamilial violence against children and adolescents with educational purposes, besides presenting the importance of the Menino Bernardo Law to break the culture of violence. It also seeks to discuss the conflict of rights generated by this law, namely: the freedom of parents to punish their children and the right of these children to have their physical and psychological integrity safeguarded in the family environment. To do so, it is imperative to present the limits of family power and the necessary state intervention to ensure the best interests of the child. Thus, through the analysis of several legal norms that seek to protect the rights of this vulnerable portion of the population and through a doctrinaire and case study, it is possible to verify that violence should not be associated with education, because these two terms are exclusive. |
