O trabalho informal e a previdência social no Brasil: uma análise da uberização e seus reflexos nos direitos previdenciários do trabalhador

Abstract

The article seeks a bibliographic analysis about the evolution in labor relations through which Brazil has passed, in order to understand and conceptualize the current growing model among informal workers, the so-called uberized or platform work. The vision that guides the study is the analysis of the precariousness that this work can impose on the worker, in their working conditions and income, as well as the reflexes of this informality for the social security law, whether in the collection of revenue by Social Security, or by the lack of social protection for those who carry out such activities and have not joined the RGPS (General Social Security Regime). Throughout the topics, it remains to be shown how society behaved so that it was possible to reach the present moment, in which the fastest growing work relationship in the country is coincidentally the one that is devoid of legal regulation regarding the rights and social protection of workers. It is shown that in the absence of a rule on the subject, the judiciary is already provoked to decide issues related to this work. Finally, it is concluded that the advance of informality, through uberized work, represents for workers, a setback in their labor rights and for the state, a hole in social security collection, which can, in the long term, compromise the stability of the social protection system.
