| Summary: | Esta pesquisa tem o intuito de abordar a atual situação do sistema de adoção brasileiro, especialmente quanto ao Cadastro Nacional de Adotantes, evidenciando suas falhas e lacunas e como estas refletem na sociedade brasileira, questionando, à luz do Projeto de Lei do Senado 394 de 2017, a necessidade de uma revisão legislativa e do acolhimento normativo da Adoção Intuitu Personae, utilizando por base o princípio do melhor interesse da criança. Pretende-se abordar o conceito de Adoção e sua evolução histórica no ordenamento brasileiro. Pretende-se dissecar o funcionamento do Cadastro Nacional de Adotantes e analisar suas falhas, as quais levaram à redação da proposta de Lei para criação de um Estatuto da Adoção. Pretende-se ainda, ao conceituar e esclarecer a Adoção Intuitu Personae, apontar a necessidade de sua regulamentação. Para tanto, a pesquisa percorrerá um caminho entre a CF/88 e o Estatuto da Criança e do Adolescente. |
| Abstract: | This research aims to approach the current situation regarding the brazlian adoption system, especially the National Adopters Register, highlighting its fails and gaps and how they reflect on the brazilian society, questioning, in the light of the 2017 394 senate bill, the need for a legislation revision and a regulatory admition of the Intuitu Personae Adoption, on the basis of the best interest of the child principle. It is intended here to adress the concept of adoption and its historical evolution in the brazilian legal order. It is intended to dissect the working of the National Adopters Register and analyse it’s fails, that led to the proposition of the Statute of Adoption. Moreover, it is intended, after conceptualizing and clarifying Intuitu Personae Adoption, to point the need of its regulamentation. For this purpose this research will range between the Constitution of 88 and the Statute of the Chil and Adolescent. |
