| Summary: | Este artigo busca analisar os efeitos da alteração legislativa provocada pela Lei 13.964/2019, a qual modificou o artigo 492, I, “e”, do CPP e possibilitou a execução imediata da pena após condenação pelo Tribunal do Júri antes da possibilidade de revisão da condenação em sede de apelação, tema sensível que confere divergências no âmbito jurídico. Será utilizado como método de pesquisa dedutivo, na tentativa de se fazer das regras gerais, a solução para casos específicos com base na Constituição e na legislação processual penal. |
| Abstract: | This article seeks to analyze the effects of the legislative change caused by Law 13.964/2019, which modified article 492, I, “e”, of the CPP and made it possible to immediately execute the sentence after conviction by the Jury Court before the possibility of reviewing the sentence. conviction on appeal, a sensitive issue that gives rise to differences in the legal scope. It will be used as a deductive research method, in an attempt to make the general rules the solution for specific cases based on the Constitution and criminal procedural legislation. |
