Summary:	Pretende-se nesse trabalho abordar assuntos teóricos e instigar transformações no direito brasileiro, em especial na execução penal acerca da temática dos direitos da dignidade da pessoa humana da comunidade LGBTQIAP+. Para isso, utilizar-se-á o método dedutivo, partindo-se da abrangência do direito fundamental da dignidade da pessoa humana chegando ao reconhecimento de que de fato esses direitos não são garantidos à classe hipervulnerável durante o cumprimento de suas penas e o método argumentativo ou dialético, estabelecendo-se uma conexão entre a contextualização de toda a evolução do direito penal em face da comunidade supracitada com fatos e a realidade enfrentada dentro do sistema carcerário. Por fim, constatar-se-á que esses direitos precisam deixar o plano das ideias e fixarem-se no plano da realidade, a fim de que se tornem efetivos e eficazes quanto à proteção e a realização de um encarceramento digno.
Abstract:	The aim of this paper is to address theoretical issues and instigate transformations in Brazilian law, especially in criminal execution towards the theme of human dignity rights of the LGBTQIAP+ community. For this purpose, the deductive method will be used, from the scope of the fundamental right to the dignity of the human person to the recognition that, in fact, these rights are not guaranteed to the hypervulnerable class during the fulfillment of their sentences. Will also be used the argumentative or dialectical method to establishing a connection between the contextualization of the entire evolution of criminal law in the face of the aforementioned community with facts and the reality faced within the prison system. Finally, it will be noted that these rights need to leave the theoretical lane and fix themselves on the reality, therefore becoming effective and efficient to protect and provide a dignified incarceration.
