| Resumen: | O presente artigo tem como objetivo analisar o dano existencial no contexto das relações de trabalho, instituto consagrado recentemente pela Lei 13.467/17, que incluiu na CLT o Título II-A: “Do dano extrapatrimonial”. O instituto, anteriormente reconhecido pela doutrina e jurisprudência, advém da necessidade de responsabilizar os empregadores pelos prejuízos à existência dos empregados, impossibilitando que usufruam da vida durante as horas legalmente destinadas ao descanso ou influenciem negativamente nos seus projetos de vida. Além de demonstrar os elementos essenciais para sua aplicação, serão analisados alguns julgados importantes sobre o tema e a relação entre o dano existencial e a captura da subjetividade do trabalhador, mediante a proposta de um diálogo com o campo da Sociologia do Trabalho. |
| Abstract: | This article aims to analyze the existential damage in the context of labor relations, institute recently established by Law 13.467/17, which included the CLT Title II-A: "The off-balance sheet damage". The institute, previously recognized by doctrine and jurisprudence, arises from the need to hold employers responsible for damages to the employees' existence, which make it impossible for them to enjoy life during the hours legally intended for rest or negatively influence their life projects. In addition to demonstrating the essential elements for its application, some important judgments on the theme and the relationship between existential damage and the capture of the subjectivity of the worker will be analyzed, in the light of Sociology of Work. |
