Violência contra a mulher: uma análise histórica e o papel do direito no combate a violência de gênero no Brasil.

Abstract

The history of violence against woman is still a lot vague for scientific literature, once there are many types of violence, for example: domestic, physical, moral, patrimonial and psychological violence. They were tolerated, until, finally, prohibitions and statutes were sanctioned, starting to guarantee pseudo-equality between the sexes. The violence is viscerally connected to the fact that woman was always seen as an object belonging to their husbands, seen as "the fair sex". There was also always a gender inequality, where the male was seen as virile, dominant and providing of resources to their wife and kids. Therefore, woman was prohibited per years to study, vote and to have any kind of individual liberty. This begins to change when the feminist movements start, starting a new phase, making more woman concerned about their own rights, and willing to fight for a fairer and egalitarian society, gaining a more practical and real strength with the promulgation of the 11.340/06 Law, also known as Maria da Penha Law, e of the 13.104 Law of 09 March 2015, that changed the 121° Criminal Code's article, known as the “Feminicide’s Law”.
