| Title: | A (des)proteção à saúde e segurança do trabalhador em face da Reforma Trabalhista: perspectivas para o meio ambiente do trabalho |

| Summary: | O meio ambiente do trabalho se insere no meio ambiente como um todo, o qual, inclusive, integra o rol dos direitos humanos fundamentais. Importantes direitos trabalhistas, diretamente relacionados à segurança e medicina do trabalho, fazem parte dos Direitos Sociais, como por exemplo os adicionais de insalubridade e periculosidade, encontram-se expressamente previstos no art. 7º da CF/1988 (inciso XXIII). O mesmo ocorre com o mandamento constitucional de “redução dos riscos inerentes ao trabalho, por meio de normas de saúde, higiene e segurança” (art.7º, XXII, da CF/1988). A Reforma Trabalhista no Brasil, por meio da Lei nº13.467/2017, alterou vários pontos da CLT, inclusive normas relacionadas à saúde e segurança do trabalhador e busca romper com a lógica civilizatória, democrática e inclusiva do Direito do Trabalho, por meio da desregulamentação ou flexibilização de suas regras imperativas incidentes sobre o meio ambiente (segurança e medicina) do trabalho. |
| Abstract: | The work environment is embedded in the environment as a whole, which also includes the role of fundamental human rights. Significant labor rights, directly related to safety and occupational medicine, are part of the Social Rights, such as the additional ones of insalubrity and dangerousness, are expressly foreseen in art. 7 of the CF / 1988 (subsection XXIII). The same is true of the constitutional injunction to "reduce the risks inherent in work by means of health, hygiene and safety standards" (art.7, XXII, CF / 1988). The Labor Reform in Brazil, through Law No. 13467/17, amended several points of the CLT, including norms related to workers' health and safety, and seeks to break with the civilizing, democratic and inclusive logic of Labor Law through deregulation or relaxation of its mandatory rules on the environment (safety and medicine) of work. |
