| Summary: | O presente trabalho tem a finalidade de analisar a normatização, o significado e a eficácia do exercício do princípio da soberania popular, matriz do princípio democrático regente e integrante da estrutura do Estado Democrático de Direito Brasileiro pós Constituição de 1988. O estudo foi desenvolvido utilizando como referencial a lei 9709/98, que regulamenta a matéria da participação ativa da sociedade do processo legislativo, com objetivo de indicar a distância entre o grau de democracia praticado com o esperado e possível. Possível via constatação da utilização de alternativas de participação ativa da sociedade na regulamentação de decisões de manutenção e direção do Estado. |
| Abstract: | This work aims to analyze the standardization, the meaning and the effectiveness of the exercise of popular sovereignty, which is the matrix of the regent democratic principle and integral part of the Democratic State of Brazilian Law post-Constitution of 1988. The study was developed using as a reference the law 9709/98 that regulates the issue of the active participation of society in the legislative process, in order to indicate the distance between the degrees of democracy practiced with the expected and possible. The possible degrees are made through the observation of the use of alternatives of the active participation of society in the regulation of decisions of maintenance and direction of the State. |
