Summary:	O trabalho trata da efetivação de direitos fundamentais e da promoção da dignidade humana dos transexuais por meio da alteração do nome e sexo no Registro Civil. Como meio de buscar a quista efetivação e promoção apresenta-se a teoria de gênero de Joan W. Scott de forma que se compreenda o significado do termo enquanto categoria analítica, e assim seja possível oferecer uma resposta jurídica satisfatória.
Abstract:	The work discusses the fundamental rights and clarifies transsexual human dignity throught the charge of name and gender in the Civil Register of individuals. As a way to achieve a high and respected promotion among society using the theory of Joan W. Scott in a way we understand the meaning of the term as an analytical category and thus it turns possible to offer a satisfactory legal answer.
