Resumo
presente trabalho arguiu os principais aspectos do assédio moral nas relações de trabalho, fenômeno este tratado em diversos países e por estudiosos de várias áreas. Trata-se de um assunto contemporâneo no país e que a legislação e o Poder Judiciário estão em constante inovação para solucionar e combater esta violência no ambiente laboral. Para isto, inicialmente analisa-se a perspectiva geral e histórica do assédio moral, as principais matérias analisadas nas regiões nórdicas e as primeiras estatísticas. Discorrem-se, então, sobre os diferentes tipos de assédio moral, os métodos, as características do agressor e vítima, além das consequências causadas por estas agressões. Por fim, são abordadas as questões do assédio moral no ordenamento jurídico brasileiro, a legislação específica, a responsabilidade civil e os principais casos e jurisprudências acerca deste tema.
Abstract
The present work argued the main aspects of harassment in labor relations, a
phenomenon that is treated in several countries and by scholars from different areas.
This is a contemporary issue in the country and the legislation and the Judiciary are
constantly innovating to solve and combat this violence in the workplace. To do this,
we initially analyze the general and historical perspective of bullying, the main issues
analyzed in the Nordic regions and the first statistics. Then, we discuss the different
types of bullying, the methods, the characteristics of the aggressor and the victim, as
well as the consequences of these aggressions. Finally, the issues of bullying in the
Brazilian legal system, specific legislation, civil responsibility and the main cases and
jurisprudence on this specific topic.
