Resumen: O presente trabalho investiga a aplicação seletiva do princípio da soberania no Direito Internacional contemporâneo, tomando como objeto a atuação dos Estados Unidos na América Latina e seus reflexos sobre a responsabilização internacional do Estado. Parte-se do problema de pesquisa consistente em verificar de que modo a soberania, concebida juridicamente como atributo universal dos Estados e fundamento da igualdade soberana, é mobilizada de forma diferenciada conforme a posição ocupada pelos sujeitos na estrutura internacional de poder. A hipótese sustentada é a de que a soberania opera, na prática, como prerrogativa seletiva: enquanto funciona como mecanismo de proteção contra a responsabilização quando invocada por grandes potências, encontra limites significativos quando reivindicada por Estados periféricos. Para demonstrar essa hipótese, adota-se metodologia de natureza qualitativa, mediante pesquisa bibliográfica e documental, com abordagem dedutiva, fundamentada na literatura crítica do Direito Internacional e na análise de exemplos paradigmáticos envolvendo a atuação dos Estados Unidos na América Latina, especialmente os exemplos da Nicarágua, Cuba e Venezuela. Examina-se, inicialmente, a formação histórica da soberania e sua vinculação às estruturas coloniais e neocoloniais que marcaram o desenvolvimento do Direito Internacional. Em seguida, analisam-se intervenções políticas, econômicas e jurídicas promovidas pelos Estados Unidos, evidenciando a utilização de instrumentos de coerção econômica, sanções unilaterais e mecanismos institucionais que condicionam a autonomia de Estados latino-americanos. Por fim, demonstra-se que, embora o regime jurídico da responsabilidade internacional disponha de instrumentos formais para a imputação de atos internacionalmente ilícitos, sua efetividade permanece condicionada às hierarquias que estruturam a ordem internacional. Conclui-se que a soberania, longe de constituir garantia uniforme de igualdade entre os Estados, é instrumentalizada de maneira seletiva, contribuindo para a reprodução de relações de poder, para a limitação da responsabilização internacional das grandes potências e para a manutenção de estruturas contemporâneas de dependência e dominação.
Abstract: This study investigates the selective application of the principle of sovereignty in contemporary International Law, focusing on the actions of the United States in Latin America and their implications for State responsibility. It addresses the research problem of how sovereignty, legally conceived as a universal attribute of States and the foundation of sovereign equality, is applied differently according to each State's position within the international power structure. The central hypothesis is that sovereignty operates, in practice, as a selective prerogative: while it functions as a shield against international accountability when invoked by major powers, it faces significant limitations when claimed by peripheral States. To test this hypothesis, the research adopts a qualitative methodology based on bibliographical and documentary research, using a deductive approach grounded in critical International Law scholarship and the analysis of landmark cases involving United States actions in Latin America, particularly Nicaragua, Cuba, and Venezuela. The study first examines the historical development of sovereignty and its relationship with the colonial and neocolonial structures that shaped International Law. It then analyzes political, economic, and legal interventions carried out by the United States, highlighting the use of unilateral sanctions, economic coercion, and institutional mechanisms that constrain the autonomy of Latin American States. Finally, it demonstrates that, although the legal framework governing State responsibility establishes formal mechanisms for attributing internationally wrongful acts, its practical effectiveness remains conditioned by the hierarchical structure of the international order. The study concludes that sovereignty, rather than ensuring equal protection for all States, is selectively instrumentalized, contributing to the reproduction of power asymmetries, limiting the international responsibility of major powers, and reinforcing contemporary structures of dependence and domination.
