| Summary: | Este artigo científico investiga a importância e a efetividade do direito ao intérprete no processo penal brasileiro, destacando os desafios enfrentados por réus estrangeiros que não dominam o português. A análise evidencia que intérpretes especializados não são meras formalidades, mas instrumentos essenciais para garantir ampla defesa, contraditório, devido processo legal e dignidade humana. Fundamenta-se em doutrina especializada, legislação nacional (Lei nº 13.445/2017) e tratados internacionais (Convenção de Viena, Pacto Internacional sobre Direitos Civis e Políticos, Convenção Americana de Direitos Humanos). Além da relevância jurídica, o estudo explora implicações sociais e econômicas, como a criação de empregos especializados e a profissionalização da interpretação jurídica. Conclui que assegurar intérpretes qualificados fortalece a justiça social, promove inclusão, valoriza a contribuição de estrangeiros e estimula a consciência coletiva sobre direitos humanos universais, despertando reflexão crítica sobre a efetividade do sistema judicial brasileiro. |
| Abstract: | This scientific article examines the significance and effectiveness of the right to an interpreter in the Brazilian criminal justice system, focusing on the challenges faced by foreign defendants who do not speak Portuguese. The study demonstrates that specialized interpreters are not mere formalities but essential instruments for ensuring broad defense, adversarial proceedings, due process, and human dignity. It is grounded in specialized doctrine, national legislation (Law No. 13,445/2017), and international treaties (Vienna Convention, International Covenant on Civil and Political Rights, American Convention on Human Rights). Beyond legal importance, the research highlights social and economic implications, such as job creation and professionalization of legal interpretation. The article concludes that guaranteeing qualified interpreters strengthens social justice, promotes inclusion, values foreigners’ contributions, and fosters collective awareness of universal human rights, engaging readers in critical reflection on the effectiveness of the Brazilian judicial system. |
