| Summary: | O presente artigo faz uma análise do desenvolvimento do conceito de família, tendo em vista o reconhecimento de novas relações familiares, com foco principal nas relações poliafetivas e, principalmente, como se dá o processo de sucessão nessas relações. As relações poliafetivas são aquelas constituídas por uma pluralidade de pessoas em que há o consentimento de todas as partes envolvidas. Apesar da relevante importância do tema no contexto atual, essa organização familiar ainda encontra diversos obstáculos, dentre eles, o presente trabalho dará destaque a transferência sucessória nas relações poliafetivas e o reflexo do reconhecimento dessas relações no direito de família, tendo como guia o princípio da afetividade. Será utilizado como método de pesquisa o método dedutivo, na tentativa de se fazer das regras gerais, a solução para casos específicos e será utilizado o estudo dogmático jurídico, visto a impossibilidade de um estudo profundo sem que se recorra à lei, à doutrina ou à jurisprudência neste sentido. |
| Abstract: | This article analyzes the development of the concept of family, with a view to recognizing new family relationships, with a main focus on polyaffective relationships and, mainly, how the succession process occurs in these relationships. Polyaffective relationships are those formed by a plurality of people in which there is the consent of all parties involved. Despite the relevant importance of the topic in the current context, this family organization still encounters several obstacles, among them, the present work will highlight the succession transfer in polyaffective relationships and the reflection of the recognition of these relationships in family law, taking as a guide the principle of affectivity. The deductive method will be used as a research method, in an attempt to make general rules the solution for specific cases and dogmatic legal study will be used, given the impossibility of an in-depth study without resorting to the law, doctrine or jurisprudence in this sense. |
