Ecoando vozes de resistência: construindo novas perspectivas a partir da problematização do direito internacional hegemônico

Abstract

This article aims to criticize the construction of international law based on hegemonic foundations. It will also address how Latin American peasant movements, such as the Movimento dos Trabalhadores Rurais Sem Terra (MST), act in a counter-hegemonic way, highlighting the contradictions that Western interference has had in the region, in silencing subjugated voices and objectifying them, thus seeking to rescue their contributions. The construction of international law and its role in promoting values and ideals of central economies are discussed, highlighting how international institutions and organizations used the discourse of development and human rights in a hegemonic way. Issues such as the super-exploitation of labor and the establishment of private land ownership are also discussed. In this way, adopting the dialectical method, it was possible to identify the contradictions between past and present that permeate international law, addressing the Decolonial Theory to explain the process of problematization of the field and Marxist Theory of Dependence to address the economic and social implications in the Latin American territory, considering the contributions of both, without intending to confront them. Finally, the research is classified as descriptive-explanatory, as it describes how the foundations of international law are linked to hegemonic views, as well as discusses how Latin America's dependence on capitalist countries has led to the radicalization of land struggle movements, producing different perspectives from their actions.
