| Resumen: | O presente artigo tem por objetivo analisar quais os reflexos das Leis da Guarda Compartilhada (13.058/14) e de Alimentos (5.478/68) no contexto da monoparentalidade feminina no Brasil, a fim de avaliar se as referidas legislações são efetivas no tratamento dessa problemática. Nesse contexto, procedeu-se à análise minuciosa de como se apresenta a monoparentalidade feminina no Brasil, qual o peso dos papéis sociais de gênero nesse contexto, qual o comportamento da legislação diante desses arranjos familiares, bem como o que os dados estatísticos dizem sobre as famílias monoparentais chefiadas por mulheres. Buscou-se evidenciar, nessa oportunidade, como as Leis da Guarda Compartilhada (13.058/14) e de Alimentos (5.478/68), bem como as outras normas referentes aos institutos, são inertes ao contexto da monoparentalidade feminina no Brasil, de modo que se faz necessário problematizar como esse cenário, que é estrutural no contexto das famílias brasileiras, deveria ser tratado pela legislação com a especificidade inerente à questão. |
| Abstract: | The present article aims to analyze which are the reflexes of the Joint Custody (13.058/14) and Alimony (5.478/68) Laws in the context of single parenthood in Brazil, in order to evaluate if the referred legislations are effective in the treatment of this issue. In this context, we proceeded to the detailed analysis of how female single parenthood is presented in Brazil, what is the weight of the social roles of gender in this context, what is the behavior of the legislation before these family arrangements, as well as what the statistical data say about single-parent families headed by women. We tried to evidence, in this opportunity, how Joint Custody (13.058/14) and Alimony (5.478/68) Laws, as well as other norms about the institutes, are inert to the context of single parenthood in Brazil, so that it is necessary to problematize how this scenario, which is structural in the context of Brazilian families, should be treated by legislation with the specificity inherent to the issue. |
