| Summary: | Subjetividade maquínica e os direitos fundamentais: por um Direito Penal humanitário é um trabalho que utiliza a matriz Subjetividade Maquínica + Sociedade do Desempenho. Destina-se a pensar subjetividade e liberdade (enquanto autonomia e enquanto direito fundamental), analisando o Direito Penal enquanto regulador da liberdade. Para tanto, aborda a evolução do Estado, de modo a caracterizar o Estado de Direito, o Estado de Direito Social e chegar ao Estado de Direito Jusfundamental – este ancorado nos direitos à liberdade, à igualdade e à dignidade. Aprofunda o problema da liberdade como autonomia, analisando, através da esquizoanálise, o Direito Penal como máquina de subjetivação atomizante e padronizadora. Propugna, em alternativa, que o Direito Penal tanto mais atende suas diretrizes constitucionais quanto menos intervir sobre a liberdade. |
| Abstract: | Machinic subjectivity and fundamental rights: for a humanitarian criminal law is a work that uses the matrix Machinic Subjectivity + Society of Performance. It aims to think about subjectivity and freedom (as autonomy and as a fundamental right), analyzing Criminal Law as a regulator of freedom. To do so, it addresses the evolution of the State, in order to characterize the Rule of Law, the Social Rule of Law and reach the Jusfundamental Rule of Law - this one anchored in the rights to freedom, equality and dignity. It deepens the problem of freedom as autonomy, analyzing, through schizoanalysis, the Criminal Law as an atomizing and standardizing subjectivation machine. It argues, alternatively, that Criminal Law meets its constitutional guidelines the less it interferes with freedom. |
