| Summary: | O presente artigo busca analisar a definição de família, por meio da lente dos Direitos humanos, para abrir a definição da família e formular uma compreensão, onde, a livre formação seria o cerne para o Direito de família Internacional. Tendo como fundamentos os princípios do Direito Internacional para o reconhecimento de tal concepção. Utilizando se dos conceitos construtivistas jurídicos de consenso, orientando o entendimento dos Estados a respeito da família e a sua livre formação e composição. |
| Abstract: | This article seeks to analyze the definition of family, through the lens of Human Rights, to open the definition of the family and formulate an understanding, where free education would be the core of International Family Law. Based on the principles of International Law for the recognition of such a concept. Using the legal constructivist concepts of consensus, guiding the understanding of States regarding the family and its free formation and composition. |
