Resumo
O presente artigo pretende explorar e compreender o conceito original de jogo duro constitucional (Constitutional Hardball), inicialmente discutido por Mark Tushnet, oriundo dos debates políticos americanos, a fim de usá-lo como chave analítica para o estudo do impeachment de Dilma Rousseff em 2016 no Brasil, analisando a existência de atos de jogo duro constitucional e a constitucionalidade do fato. Aclarando os debates envolvendo a tensão existente entre atos formalmente e materialmente constitucionais que, entretanto, subjetivamente ferem o que se tem por princípios e interpretações constitucionais implícitas e preexistentes. Por fim, foram apontados os possíveis reflexos que esses atos geram em um regime democrático.
Abstract
This article aims to explore and understand the original concept of constitutional hardball (Constitutional Hardball), initially discussed by Mark Tushnet, from the American political debates, in order to use it as an analytical key for the study of Dilma Rousseff's impeachment in 2016 in Brazil, analyzing the existence of acts of constitutional hard game and the constitutionality of the fact. Clarifying the debates involving the existing tension between formally and materially constitutional acts that, however, subjectively hurt what one has by pre-existing and implicit constitutional principles and interpretations. Finally, the possible reflexes that these acts generate in a democratic regime were pointed out.
