Jogo duro constitucional e o impeachment de Dilma Rousseff: o conceito original de Constitutional Hardball como lente de análise para o evento brasileiro

Abstract

This article aims to explore and understand the original concept of constitutional hardball (Constitutional Hardball), initially discussed by Mark Tushnet, from the American political debates, in order to use it as an analytical key for the study of Dilma Rousseff's impeachment in 2016 in Brazil, analyzing the existence of acts of constitutional hard game and the constitutionality of the fact. Clarifying the debates involving the existing tension between formally and materially constitutional acts that, however, subjectively hurt what one has by pre-existing and implicit constitutional principles and interpretations. Finally, the possible reflexes that these acts generate in a democratic regime were pointed out.
