| Summary: | O presente estudo objetiva analisar a família em suas mais diversas formações e como o afeto tem relação direta com suas mudanças e sua formação atual. Trata-se de estudo a respeito do fenômeno do abandono afetivo ainda tão presente em várias entidades familiares e como este abandono pode ou não ensejar uma indenização pecuniária à crianças e adolescentes que tiveram um escasso ou nenhum tipo de suporte afetivo por seus genitores. A análise é realizada através do método lógico dedutivo, partindo do exame das normas constitucionais, princípios gerais e específicos do Direito de família, normas gerais e legislação esparsa. A pesquisa é orientada a partir de posicionamento doutrinário jurídico e no sistemanormativo pátrio, vez que o tema aqui ainda não se encontra pacificado junto aos tribunais brasileiros. O referido estudo visa ainda analisar os pontos de vista sobre a possibilidade ou não da responsabilização pecuniária por abandono afetivo para tanto, explana-se sobre doutrinadores e juristas com opiniões distintas sobre o tema. Por fim, faz-se uma breve análise sobre a Lei nº 13.058, Lei da Guarda compartilhada como uma alternativa ao problema social que é o abandono afetivo. |
| Abstract: | The present study aims analyze the family and their several formation and how the affection is straight related with your changes and the current formation. It is a study about of the phenomenon affective abandonment and still present in several families and how this abandonment can or not to attempt a financial compensation to the children and adolescents that did not have any kind of affection from their parents. The analysis is performed through the deductive logic method, from the constitutional rules, general principles and specific of family right, general rules and sparse legislation. The research is oriented from the doctrinal legal position and the brazilian normative system, once the present analyzed system is not pacified yet with the brazilian courts. The self-reported study aim analyze the points of view about the possibility or not of the financial responsibility for affective abandonment, it was understood about the legal professors and jurists with different opinions about the theme. Ultimately, it is made a brief analyze about the shared custody as a possible alternative to th social problem which is affective abandonment. |
