| Summary: | Este trabalho se destina a analisar a eficácia da legislação brasileira no combate e prevenção dos crimes de gênero. O trabalho analisa, por meio do método dedutivoindutivo, os crimes que são motivados por gênero. Considera-se gênero os papéis socialmente destinados a cada pessoa em função de seu aparato sexual, que, de certa forma, irão determinar seu comportamento social e sexual esperado pela sociedade na qual essa pessoa está inserida. Foram feitas análises da evolução histórica das lutas de gênero, bem como da efetividade normativa da legislação brasileira relacionada ao tema. Utilizando-se o conceito de crimes de gênero apresentado por instituições internacionais como um parâmetro de análise, este trabalho analisa a abrangência e a efetividade da legislação brasileira no combates as esses crimes através da exposição de posicionamentos jurisprudenciais e jurídico-doutrinários a respeito da Lei Maria da Penha, das lesões corporais, dos crimes contra a dignidade sexual, dos crimes contra a honra e da Lei do Feminicídio, todos analisados sob a perspectiva da luta por igualdade e identidade de gênero. |
| Abstract: | This study is destined to analyze the efficiency of the Brazilian laws on the combat and prevention of the gender based crimes. The study analyzes, by the deductive-inductive method, the crimes that are motivated by gender. It’s considered gender the roles socially given to each person according to her/his sexual organs, that, in a certain way, will determinate the social and sexual behavior that is expected by the society that the person is inserted. It analyzes the historical evolution of the gender fights, as well the normative efficiency of the Brazilian laws related to the theme. Using the concept of gender based crimes given by international institutions as a parameter of analyzes, this study analyzes the extent and efficiency of the Brazilian legislation on the combat of these crimes by the exposition of jurisprudential and juridicaldoctrine standpoints about the Maria da Penha’s Law, the bodily injury crimes, the crimes against sexual dignity, the crimes against honor and the Feminicide Law, all of them analyzed over the perspective of the fight for equality and identity of gender. |
