Subordinação algorítmica no trabalho em plataformas digitais

Abstract

This article analyzes the phenomenon of algorithmic subordination in the context of platformmediated work, with particular emphasis on transportation and delivery services. The study examines the organizational structure of digital platforms and the algorithmic management mechanisms used to coordinate, monitor, and discipline labor performance. Adopting a doctrinal legal approach combined with the analysis of judicial decisions and international regulatory experiences, the research seeks to determine whether technological control tools constitute a contemporary manifestation of the employer’s managerial authority. It is argued that algorithmic management, by exercising functions of organization, supervision, and sanction, reproduces classical elements of legal subordination, albeit under a technological framework. It concludes that the centrality of digital control reveals significant indicators of subordination, challenging narratives of full autonomy and requiring interpretative responses consistent with the protective principles of Labor Law.
