| Summary: | A pesquisa apresenta uma análise acerca das legislações sobre educação, atos jurídicos, em sentido amplo, e proteção de pessoas com deficiência, que têm por fundamento o estudo sobre a eficácia legislativa e o acesso àqueles tradicionalmente excluídos por suas dificuldades. O estudo define-se como uma pesquisa teórica com o escopo de efetivar a inclusão, dentre outros aspectos, para que os sistemas sociais respeitem e atendam às necessidades das pessoas com deficiência, e não o inverso. Assim, a presença da legislação comprova como as garantias fundamentais das pessoas com deficiência têm sido aplicadas na prática. Ademais, esta pesquisa possui a finalidade de, refletir e compreender sobre os direitos da pessoa com deficiência, incentivando o seu empoderamento e a sua evolução, a partir das legislações e jurisprudências. Assim, nesta dissertação foram discutidos os reflexos das leis pertinentes às pessoas com deficiência, a partir de direitos posteriores a LBI, analisando a partir do estudo, as jurisprudências relativas ao tema. Sendo assim, foi explanado sobre a complementariedade das leis para o auxílio no acompanhamento e garantia das oportunidades às pessoas com deficiência. Como resultado conclui-se que, o direito das pessoas com deficiência, quando não eficazes, promovem a exclusão de uma infinidade de requerentes e não solucionam os conflitos sociais no âmbito jurisdicional, necessitando de jurisprudências que reafirmam leis constitucionais ou infraconstitucionais existentes. Desse modo, considera-se que a pesquisa alcança seu propósito de colaborar para que a legislação seja eficaz às garantias desse grupo para a concretização do direito fundamental à proteção da pessoa com deficiência. |
| Abstract: | This research an analysis of legislation on education, legal acts in a broad sense, and the protection of people with disabilities, based on a study of legislative effectiveness and access for those traditionally excluded due to their difficulties. The study is defined as theoretical research with the aim of achieving inclusion, among other aspects, so that social systems respect and meet the needs of people with disabilities, and not the other way around. Thus, the presence of legislation demonstrates how the fundamental guarantees of people with disabilities have been applied in practice. Furthermore, this research aims to reflect on and understand the rights of people with disabilities, encouraging their empowerment and development, based on legislation and jurisprudence. Therefore, this dissertation discusses the impact of laws pertaining to people with disabilities, based on rights subsequent to the Brazilian Law on Inclusion of Persons with Disabilities (LBI), analyzing, through this study, the jurisprudence related to the topic. Thus, the complementarity of laws in assisting with the monitoring and guaranteeing of opportunities for people with disabilities was explained. As a result, it is concluded that the rights of people with disabilities, when ineffective, promote the exclusion of countless applicants and do not resolve social conflicts within the jurisdictional sphere, requiring jurisprudence that reaffirms existing constitutional or infraconstitutional laws. Therefore, it is considered that the research achieves its purpose of contributing to the effectiveness of legislation in guaranteeing the rights of this group and realizing the fundamental right to protection for people with disabilities. |
