Abstract

The labeling theory breaks away from classical paradigms of criminology and seeks to analyze the issue of social stigmatization faced by individuals navigating the criminal justice system. It shifts the criminological focus from actions to reactions through a critical examination of the formal control system and the hostile behavior of society. This work aims to analyze penal selectivity based on the labels imposed on offenders, considering how definitions of crime and criminality are socially constructed and influence social control over specific groups, incorporating Michel Foucault's contributions on the subject. The objective of this study is to promote an understanding of the development and insights that labeling theory has brought to the comprehension of criminal events, as well as its impact on innovations within Brazilian legal frameworks aimed at decriminalizing minor offenses.
