| Summary: | A presente monografia tem como objetivo analisar a política migratória desenvolvida no Estado Brasileiro, tendo como recorte as principais políticas estipuladas a partir da consolidação da República Federativa do Brasil e seu avanço até os anos recentes com Lei de Migração (Lei Nº 13445/2017) e o Decreto 9.199/2017 que a regulamenta. O trabalho apresentará quais os vieses que perpassaram o desenvolvimento da política migratória brasileira no período analisado, apresentando como a política externa do país foi utilizada ao longo dos anos para regulá-la. Ademais, irá contrapor a nova política às antecessoras, elucidando seus pontos de inovação. Visa-se analisar se a Lei Nº 13445/2017 e o Decreto 9.199/2017 realmente representaram um marco evolutivo em relação ao que vinha sendo desenvolvido e se é possível observar uma ruptura do posicionamento do Brasil referente a migração, deixando este de ser associado a questões de segurança nacional e passando a seguir um caráter inclusivista e associado aos Direitos Humanos. |
| Abstract: | This monograph will discuss the migration policy developed in the Brazilian State, having as a focus the main policies stipulated from the consolidation of the Federative Republic of Brazil and its advance until recent years with the New Migration Law (Law Nº 13445/2017) and Decree 9.199/ 2017 that regulates it. The work will discuss the biases that permeated the development of Brazilian migration policy in the period analyzed, presenting how the country's foreign policy was used over the years to regulate it, in addition, it will oppose the new policy to the predecessors, elucidating its points of innovation. The aim is to debate whether Law Nº 13445/2017 and Decree 9.199/2017 really represented an evolutionary milestone in relation to what was being developed and whether it is possible to observe if it were a disruption in Brazil's position ceasing to be associated with issues of national security, and moving on to an inclusive character associated with human rights. |
