Federalismo, gênero e migração nos Estados Unidos: uma análise das políticas voltadas às mulheres e população LGBT durante os governos de Barack Obama e Donald Trump

Abstract

The goal of this research is to analyze the engagement of North American states to create specific policies for migrant women and LGBT, during the mandates of Barack Obama and Donald Trump. Hence, the problematics of this research aim to understand what type of engagement and what actions are carried out by states on the gender and immigration agenda in the United States. The beginning hypothesis is that the absence of integrative policies for migrant women from the federal government brings the demands to the subnational governments, which adopt mechanisms from state legislation and integrative policies for migrating women and LGBT. From the gender cut, the analysis is based on federal and state documents in the regulations of immigration federal agencies, presidential Executive Orders and state actions and laws. This work presents the debates about American Federalism from the gender and immigration agendas as its theoretical basis. Thus, this work concludes that the sanctuary states engage more in the formulation of policies for migrant women and LGBTs, emphasizing the periods in which a greater restriction of rights is identified for this population by the federal government, during the Trump administration.
