| Summary: | O presente artigo se divide em 4 componentes: 1) Conceituar e contextualizar o direito da propriedade intelectual 2) analisar os principais tratados que regem tal matéria; 3) Fazer uma relação entre direito e moda e apontar como o chamado “fashion law” se tornou um mecanismo de proteção de famosos designers; e 4) Explicar o caso Supreme, utilizando este para apontar e analisar tanto as brechas legais que permitem tal fenômeno quanto os direitos patrimoniais e consumeristas lesados por tal ação. |
| Abstract: | The present work is divided into 4 components: 1) Conceptualize the intellectual property rights 2) analyze the main treaties that govern this matter; 3) Make a relationship between law and fashion and point out how the so-called “fashion law” has become a protection mechanism for famous designers; and 4) Explain the Supreme case, using it to point out and analyze both the legal loopholes that allow the phenomenon and the property and consumer rights harmed by such action. |
