| Summary: | O presente estudo tem por finalidade apresentar uma análise crítica da ineficiência estatal em respeitar a dignidade humana da mulher detenta, expondo e debatendo a questão carcerária sob a ótica das mulheres encarceradas, contrabalanceando o direito da punição estatal em defesa do Interesse Público e os direitos fundamentais daquelas que cumprem pena. Para tal, adotar-se-á o método dedutivo, partindo de uma breve introdução sobre os Direitos Fundamentais, explanando seu conceito e objetivo, e se chegando à discussão específica sobre a clara omissão estatal no atendimento às necessidades femininas nos vários presídios do país. |
| Abstract: | This study aims to present a critical analysis of the state's inefficiency in respecting the human dignity of women prisoners, exposing and debating the prison issue from the perspective of incarcerated women, counterbalancing the right to state punishment in defense of the Public Interest and fundamental rights of those who are serving time. The deductive method will be used, starting with a brief introduction on Fundamental Rights, explaining its concept and objectives, and coming to a specific discussion on the state omission in meeting the needs of women in prisons in the country. |
