| Summary: | O presente trabalho visa apontar os principais pontos de divergência e de convergência entre os ordenamentos jurídicos brasileiro e estadunidense, no que tange ao instituto da Recuperação Judicial de empresas, trazendo um enfoque comparativo sem o intuito, contudo, de se esgotar o tema, tampouco de definir qual o melhor entre os dois ordenamentos, possibilitando ao leitor que conclua, por si próprio, qual sistemática melhor se enquadra na situação concreta em que se encontrar. Por fim, cumpre ressaltar que o presente artigo se encontra devidamente atualizado, de acordo com a Lei nº 14.112/2020, que alterou significativamente a Lei nº 11.101/05. |
| Abstract: | The present work aims to point out the main points of divergence and convergence between the Brazilian and American legal systems, with regards to the possibility of reorganization of companies in crisis, bringing a comparative approach without the intention, however, of exhausting the theme, nor of defining which is the best between the two, enabling the reader to conclude, by himself, which system best fits the concrete situation in which he finds himself. Finally, it is importat to note that this article is duly updated, in accordance with Law nº. 14.112 /2020, which complemented Law nº. 11.101/05. |
